Response from 1&1 about ROYOUTH.com

March 1st, 2006 Posted in Web 2.0

ok, some progress on the royouth.com issue. I contacted the support rep that sent me the email and here is his my reply to his reply:

Richard,

Thank you for your reply. I will communicate this to our members.

In regards to changing the domain name to display again. Please check the support log for the calls I put in. Monday morning (Feb 27th, 2006) I called your support to ask what had happened to the domain and they were the ones who told me to change the DNS settings. With this being the first time going through this DMCA issue, I was not aware that I was forbidden to change the DNS settings to bring the site back up. Otherwise, of course I wouldn’t have in order to prevent the locking of all domains under that contract.

What I am saying is, due to the direction of your support team I brought the site back up on Monday. Because of this, I am requesting that the domains in the contract be unlocked and of course leave the royouth.com account locked until I resolve this issue with your legal team.

With respect,
Cosmin Ghiurau

Mr Ghiurau,

With respect, firstly I did only shut down the domain name, however you changed the domain name to display again, and this is what resulted in me having to lock down the whole account.

Our lawyer is on the case, and will let me know when it can be put live again, normally after 14 days, there is nothing we can do until this time.

I ask that you stop wasting our time by asking your community members to email in multiple complaints, this will not achieve anything in your favour.

Richard.

Richard,

Thank you for the email.

I must admit that this has been a shock, a surprise, and a nightmare at the same time. First of all, when I received this email it was the first time I had heard that on the online forum/photos community ‘ROYOUTH.com’
there was a violation of copyrighted materials. In our rules of the community we strictly forbid copyrighted materials to be used on our site. However, due to the traffic of the site a copyrighted material could have been left up without our knowledge. If found it would have been taken off immediately.

However, noone contacted me previous to this email that there was a copyright violation on the website. Now, the community of over 13,500 members are left without a community and I am speaking on their behalf to get a resolve to this matter as soon as possible.

Please let me know what the copyrighted material was and I will immediately take it off.

Your understanding and reply is appreciated!

With respect,

So, lets stop the emails and wait a few days as I try to deal with the legal team who I have already contacted (after researching who they were) to see what we can do to speed up the resolve.
